A. Program Description
The Provider will operate an Inpatient Forensic Unit by licensed mental health professionals who will provide statewide forensic services for juveniles adjudicated Unfit to Stand Trial (UST) and Not Guilty by Reason of Insanity (NGRI) and are remanded to the Department of Human Services for treatment on an inpatient basis. These services shall include, but are not limited to, psychiatric, mental health and substance abuse treatment services, as well as legal education, case management, transportation, court reporting and court testimony.
There are to be twelve inpatient beds available for UST and NGRI juveniles. The Inpatient Forensic Unit is designed to:
- Provide services to juveniles who are remanded by court order to DHS for forensic services on an inpatient basis; and,
- Increase the prompt access to clinically appropriate inpatient forensic services for individuals adjudicated UST and NGRI who require the restrictiveness of a hospital setting.
The Provider must bill Medicaid/Managed Care Organization (MCO) or any other billing source for payment for eligible juveniles. DMH will pay for vacant beds and non-covered juveniles. The provider agrees to admit all juveniles remanded (up to twelve) to DMH by the courts for inpatient forensic services.
Deliverables and Milestones
The Provider will:
- Ensure that the inpatient forensic services meets the statutory requirements of Illinois statutes 725 ILCS 5/104-17;
- Ensure that twelve inpatient beds are available for juveniles adjudicated as Unfit to Stand Trial and Not Guilty by Reason of Insanity;
- Bill MRO/MCO or any other billing source for payment first;
- Recruit, train, and maintain qualified staff, including a Board Certified Psychiatrist, who is to provide psychiatric services to funded and unfunded clients; other licensed professionals to provide assessment, fitness restoration services and work as a liaison between the contractor and the criminal justice system; and to coordinate discharge planning and linkage;
- Ensure prompt access to clinically appropriate psychiatric/pharmacological, psychological, treatment planning and linkage services.
- Ensure prompt access to legal education using DHS/DMH-approved curricula as needed;
- Provide transportation for patients to court and to other necessary and approved off-grounds locations
- Provide face to face individual and group fitness restoration and treatment services for individuals served in the Program to ensure participation, and promote adherence;
- Develop, maintain and follow written procedures and court reporting to establish individual's progress toward fitness restoration, readiness for return to court and conditional release;
- Provide thorough continuity of care for individuals being released to the community and back to court or who are determined not to be restorable;
- Ensure the provision of medication as needed. Discharge shall be in accordance with 725 ILCS 5/104-20(b) and should ensure that the following are in place:
- Facilitate ongoing services with the appropriate community mental health agency before final discharge from the Program if individuals are released to the community; provide Psychiatric consultation for case review and clinical input (e.g., diagnostic, risk assessment, psychopharmacology) to other DHS/DMH programs which serve MHJJ youth or other youth served by the Department.
- Ensure that individuals remanded by the court for inpatient services are admitted within the statutory time frame (725 ILCS 5/104-17)
- Complete the 30 day admission reports, individual treatment plan and progress reports per statute (725 ILCS 5/104-17; 5/104-18)
- Reporting Requirements:
- Financial Report in accordance with Exhibit C of the Uniform Grant Agreement (See B. Funding Information #6 and #7)
- Performance Report in accordance with Exhibit E of the Uniform Grant Agreement.
- The Provider shall report quarterly performance on the appropriate DMH reporting template to the DMH program contact no later than November 1, February 1, May 1, and August 1. DMH program contacts and reporting templates can be found in the Provider section of the DHS website.
- The following are included in the reporting template:
- Provider certifies that all statutory requirements are met.
- Number of beds dedicated to Juvenile Forensic program.
- Number of MRO/MCO eligible client billings.
- Provider has qualified staff including a Board Certified Psychiatrist, who is to provide psychiatric services to funded and unfunded clients; other licensed professionals to provide assessment, fitness restoration services and work as a liaison between the contractor and the criminal justice system; and to coordinate discharge planning and linkage
- Number of clients with access to clinically appropriate psychiatric/pharmacological, psychological, treatment planning and linkage services.
- Number of clients with access to legal education using DHS/DMH-approved curricula as needed;
- Number of clients that are provided transportation to court and to other necessary and approved off-grounds locations
- Number of clients that are provided face to face individual and group fitness restoration and treatment services for individuals served.
- Provider will develop, maintain and keep written procedures that can be submitted upon request.
- Number of clients that are provided thorough continuity of care for individuals being released to the community and back to court or who are determined not to be restorable
- Number of clients that have been discharged in accordance with 725 ILCS 5/104-20(b)
- Number of clients remanded by the court for inpatient services that are within the statutory time frame (725 ILCS 5/104-17)

- No less than 100% of statutory requirements are met.
- No less than 12 beds will be available for Juvenile forensic patients at any time.

- No less than 100% of clients will have access to clinically appropriate psychiatric/pharmacological, psychological, treatment planning and linkage services.
- No less than 100% of clients will have access to legal education using DHS/DMH-approved curricula as needed;
- No less than 100% of clients will be provided transportation to court and to other necessary and approved off-grounds locations
- No less than 100% of clients will be provided face to face individual and group fitness restoration and treatment services.
- 100% of clients have proper reporting showing progress toward fitness restoration, readiness for return to court and conditional release
- No less than 100% of clients will be provided thorough continuity of care for individuals being released to the community and back to court or who are determined not to be restorable
- No less than 100% of clients discharged should be in accordance with 725 ILCS 5/104-20(b).
- No less than 100% of clients remanded by the court for inpatient services will be within the statutory time frame (725 ILCS 5/104-17)
- No less than 100% of admission reports, individual treatment plan and progress reports per statute (725 ILCS 5/104-17; 5/104-18) will be submitted.
B. Funding Information
- This award utilizes appropriated state funds to fund this program. In FY18, the Department anticipates the availability of approximately $3,193,750.00 in total funding.
- The grant period is anticipated to begin on or before July 1, 2017 and will end on June 30, 2018.
- The release of this NOFO does not obligate the Illinois Department of Human Services to make an award.
- Services many not be provided until a contract is fully executed by the Department.
- This Notice of Funding Opportunity (NOFO) will cover 3 fiscal years: FY 2018, FY 2019 and FY 2020. Awards will be for a 1 year term.
- Payment will be issued in response to Provider submitted monthly invoices on the appropriate DMH invoice template at the established rate(s) (if applicable) stated in Exhibit B. Invoices shall be submitted to the DMH program contact no later than 30 days of the month following services, and will be reconciled on the basis of reported allowable expenses per the Grant Funds Recovery Act [30 ILCS 705/7 and 8]. (The Grant Funds Recovery Act is not applicable to Fixed-Rate Grants.) Rate: DMH will pay for occupied beds for non-medicaid individuals at the Healthcare and Family Services (HFS) Medicaid rate. Bed hold rate will be determined via provider submitted and DMH approved budget.
- The Provider shall report quarterly allowable grant expenses on the appropriate DMH reporting template to the DMH program contact no later than November 1, February 1, May 1, and August 1, and reported expenses should be consistent with the submitted annual grant budget. If any budget variances are noted, the DMH program contact may request that the provider submit a revised grant budget before subsequent monthly payments will be made. - During pre-qualification, verifications are performed including a check of federal Debarred and Suspended and status on the Illinois Stop Payment List.
- An automated email notification to the entity alerts the entity of "qualified" status or informs them how to remediate a negative verification (e.g., inactive DUNS, not in good standing with the Secretary of State).
- A federal Debarred and Suspended status cannot be remediated.
Indirect Cost Rate Requirements
- Federally Negotiated Rate - Organizations that receive direct federal funding may have an indirect cost rate that was negotiated with the Federal Cognizant Agency. Illinois will accept the federally negotiated rate. The organization must provide a copy of the federal approved NICRA.
- State Negotiated Rate - The organization must negotiate an indirect cost rate with the State of Illinois if they do not have Federally Negotiated Rate or elect to use the De Minimis Rate. The indirect cost rate proposal must be submitted to the State of Illinois within 90 days of the notice of award.
- De Minimis Rate - An organization that has never received a Federally Negotiated Rate may elect a de minimis rate of 10% of modified total direct cost (MTDC). Once established, the de minimis rate may be used indefinitely. The State of Illinois must verify the calculation of the MTDC annually in order to accept the de minimis rate.

Content and Form of Application Submission
Each applicant is required to:
- be registered in SAM before submitting the application;
- provide a valid DUNS number in the application; and
- continue to maintain an active SAM registration with current information at all times in which the applicant has an active Federal, Federal pass-through or State award or an application or plan under consideration by a Federal or State awarding agency.

E. Application Review Information
- Complete applications will undergo a Merit Based Review process.
- The Merit Based Review describes the evaluation criteria including Need, Capacity and Quality.
- The Merit Based Review process will include a committee that do not have any conflicts of interest.
- The Merit Based Review committee will use a scoring process to evaluate need, capacity, and quality.
- A positive Merit Based Review triggers the release of a programmatic risk assessment.
- A programmatic risk assessment is generated to evaluate the applicant's ability to execute the program. The programmatic assessment is grant-specific for targeted capacity building. The scope of assessment includes:
- Quality of management systems
- History of performance
- Reports and findings from prior audits
- Ability to effectively implement statutory and regulatory requirements
- Other agency or grant-specific areas
- Assessment responses may indicate specific conditions.
- Requirement mandate the Department to impose additional specific conditions based on programmatic risk posed.
- Specific conditions would include:
- Requiring additional project monitoring or reporting
- Requiring technical or management assistance
- Establishing additional prior approvals
- Requiring evidence of acceptable performance within a specified period
- Specific conditions enable the applicant to develop capacity in area(s) of risk potential
- The Department must specify the nature of the requirement(s), reason why the requirement(s) is imposed, nation of action needed to remove the requirement(s), the time allowed for completing action(s) and the method of requesting reconsideration of the additional requirement(s).

Criteria for Selecting Applications
- In addition to the Merit Based Review Process, consideration may then be given to past performance, if applicable.
- Funding decisions will be made based on the quality of the complete application as scored through the Merit Based Review Process.
- Final award decisions will be made by the Director of the Division of Mental Health.
- The Department reserves the right to negotiate with successful applicants to cover un-served areas that may result from this process or modify the overall budget request to meet the funding availability.
- Only the Merit Based Review Process is subject to appeal.
- An appeal must be submitted in writing and received within 14 calendar days and must include the appealing party, the grant and reasons for the appeal.
- The Department will provide an acknowledgement within 14 calendar days of receipt and a response within 60 calendar days.
This program is a 1 year contract with 2 - 1 year optional renewals. Renewals are at the discretion of the Division of Mental Health and are contingent on the meeting the following criteria:
- Provider has performed satisfactorily during the past six months;
- All required reports have been submitted on time, unless a written exception has been provided by the Division; and
- No outstanding issues are present (i.e. in good standing with all pre-qualification requirements and no outstanding corrective action detailed on Exhibit H etc.).
- Grantees are required to update their proposal narrative and submit a current year uniform budget and narrative.
It is anticipated an announcement regarding State awards will occur in June 2017.
