Personal Needs Allowance
Public Act 98-0674 provided for an increase in the Personal Needs Allowance for individuals residing in Intermediate Care Facilities for Individuals with Developmental Disabilities (ICFs/DD) licensed under the Intellectual Disabilities/Developmental Disabilities Community Care Act, as well as individuals residing in Community Integrated Living Arrangement (CILA) settings. This Act included a provision, however, that this increase was for State Fiscal Year 2015 only, with dates of service beginning on or after September 1, 2014, through June 30, 2015.
This Information Bulletin is issued to inform providers and other interested parties of the return to the previous Personal Needs Allowance levels in effect prior to September 1, 2014: $30 for individuals residing in ICFs/DD and $50 for individuals residing in CILA settings.
Information Bulletin DDD.014.040 announced the increase to $60 for the time period on and between September 1, 2014 and June 30, 2015. The $60 level is still in effect for those service dates.
Process and Procedure
Proposed rules, in accordance with Public Act 98-0674, are being developed with the Department of Healthcare and Family Services. They will be published for public comment shortly. The rule being amended is 89 Illinois Administrative Code 120.61. The amendatory language includes a retroactive effective date of July 1, 2015.
The offsets applied to ICF/DD and CILA rates are being modified consistent with the Act. Caseworkers in the Family Community Resource Centers are being informed of the change with regard to the offsets for individuals residing in ICFs/DD. The CILA rate adjustments are underway by the Division of Developmental Disabilities.
The return to previous Personal Needs Allowance levels is effective for dates of service on or after July 1, 2015. Beginning State Fiscal Year 2016, with dates of service beginning on or after July 1, 2015, the personal needs allowance will return to $30 for individuals residing in ICFs/DD and $50 for individuals residing in CILA settings.
