Proposed Rule 140 Publication Delay

Upon further consideration, DHS/DMH has decided to delay the publication of the Proposed Rule 140. As you are aware from previous conversations and meetings, our original intent was to work on parallel tracks to finalize Rule 140 that would set minimum standards, define the specific services and establish other quality standards while at the same time moving ahead with work groups that would work with an outside expert on rate and rate methodology.
Unfortunately, we have experienced a delay in obtaining the expert consultation for the rate and rate methodology discussions. Consequently, we believe that the better course will be to finalize the rate and rate methodology before publishing the 140 Rule. We expect to convene the work groups by mid-May and look forward to your participation in the process.
It seems to me that it is more important than ever to resolve these challenging issues that affect the decisions of federal and state funders, practice of service providers and ultimately access to care for our citizens. That said, I am similarly, more confident than ever that we will together craft standards and practices that meet the needs of the people that we serve.
