MR #12.19: Medical Benefits for Persons in an Illinois Jail

Summary:

When a person on an active case is in an Illinois jail, do not terminate medical benefits due to living in a public institution.
For medical, persons in a local jail or juvenile detention facility must meet all other eligibility requirements for Aid to the Aged, Blind and Disabled (AABD) or Family Health Plans (FHP) to remain active for medical benefits.
Although the person remains active for medical benefits, they only qualify for inpatient hospital and professional services rendered during the hospital stay.
The County Jail Act changes the threshold to $500 for payments made by HFS to county jails.
Policy regarding inmates in the custody of the Illinois Department of Corrections or the Department of Juvenile Justice will be issued separately.
