MR #12.01: The Appeal Process and Conducting the Pre-Hearing Meeting by Phone

Summary:

  • In an effort to improve customer service and to reduce the number of appeals that progress to the appeal hearing, staff are reminded that the worker and supervisor are to conduct a pre-hearing review of the case within 7 days of the date the request for appeal is received to determine if the correct action was taken on the case.
  • Within 10 days of an appeal being filed, a pre-hearing meeting must be scheduled with the client. 
  • This release changes policy to specify that the pre-hearing meeting may be conducted by phone.
  • If the result of the pre-hearing meeting is the client wants to withdraw the appeal, the withdrawal of the appeal must be in writing.
  • Email or fax (312-793-8573) the client's written statement of appeal or completed Form 103 to Bureau of Assistance Hearings within 48 hours of receipt. When emailing client's written statement of appeal or Form 103 use the following email address, bahnewappeal@illinois.gov. Do not mail the client's written statement of appeal or completed Form 103 to BAH.
  • Any evidence (exhibits) that is provided at the Appeal Hearing must be emailed or faxed to BAH within 24 hours of the appeal hearing meeting.  When emailing evidence to BAH use the following email address, bahexhibits@illinois.gov.
