MR #11.04: Documenting U.S. Citizenship and Identity for Medical

Summary:

  • The Deficit Reduction Act of 2005 requires persons receiving Family Health Plans (FHP), Temporary Assistance to Needy Families (TANF), Aid to the Aged, Blind, and Disabled (AABD) and children receiving General Assistance-Family and Children Assistance (GA-FCA) to provide documentation of U.S. citizenship and identity.
  • Proof of citizenship is not required for U.S. citizens requesting or receiving SNAP or adults age 19 and older requesting or receiving General Assistance (TA and FCA).
  • A document issued by a federally recognized Indian Tribe showing affiliation with that tribe is considered primary evidence of U.S. citizenship.
  • This release clarifies that form 3162 Declaration Regarding Citizenship/Alien Status is not required for medical benefits cases. 
  • This release incorporates into the Manual the list of accepted documents.
  • This release also incorporates the Item 74 codes reflecting documentation status.
  • The WAG table Program Eligibility by Citizenship is corrected for noncitizens paroled for one year to the U.S. under section 212(d)(5) or granted conditional entry under 203(a)(7).
  • Persons who state they are U.S. citizens and do not provide documentation of citizenship or identity will not be denied, deleted, or canceled at this time.
  • New policy regarding the documentation of U.S. citizenship and identity will be issued soon.
