MR #09.10: FS Work Requirement and Overpayment Provisions of the Stimulus Act

Summary:

The American Recovery and Reinvestment Act of 2009 prohibits using the temporary food stamp benefit increase granted under that Act in determining the amount of an overpayment.
For food stamp overpayments, do not include the amount of the benefit increase granted under the stimulus Act. This includes the benefit increase that was effective for March 2009 Groups 05-09.l
Do not use the ACM OverIssuance/Underissuance Calculation to determine overpayments effective for March 2009 Groups 05-09 and April 2009 and later for all Groups. Changes are not yet complete.
Due to changes in the American Recovery and Reinvestment Act of 2009 that suspends restrictions on Able Bodied Adults with Dependent (ABAWDS) Children, the statewide exemption for the Food Stamp Work Requirement is extended through 09/30/2010.
Persons who were previously deleted due to the work requirement may now be eligible.
