What HFS seeks repayment for depends on whether the client was employable when the accident happened. Someone is employable if they are either:
- at least 16 and employed full or part-time; or
- are not exempt from mandatory registration.
HFS will seek repayment for all cash and medical benefits paid to clients who were employable at the time of the injury. The total includes everything spent from the date of the injury until the settlement is made. It also includes any benefits paid to dependents of the client, either in the same benefit unit or in other units.
HFS seeks repayment for medical benefits only for clients who were unemployable when the accident happened.
