Purpose:

Clarification of timeframe to require a new fingerprint and/or background check prior to employment for a Community Integrated Living Arrangement (CILA) agency is being provided by the Division of Developmental Disabilities (DDD). A CILA provider must not employ any individual (including contractual workers, volunteers, or practitioners responsible for caring for individuals) in any capacity until the appropriate screenings and checks have been completed as noted below.

Background:

Rule 115 dictates timeframe in which a fingerprint must be provided to an agency before a new employee can work in the CILA. The fingerprint is provided for records

Mandatory Registry Checks and Background Screening Prior to Employment Effective Rule: 115.320(b)(3)(4)

Definitions:

  • CILA Provider: The licensed agency providing CILA services to individuals with developmental disabilities.
  • Employee: A person any individual hired, employed, or retained, whether paid or on a volunteer basis within a CILA

Requirements:

A CILA provider must not employ any individual (including contractual workers, volunteers, or practitioners responsible for caring for individuals) in any capacity until the following checks have been completed:

Timing of Inquiries:

The provider must inquire and receive results from all applicable registries before employment begins.

  • Important: Registry inquiries cannot be conducted more than 30 calendar days prior to the individual's first day of employment.

Fingerprint-Based Background Check (FEE_APP):

For recently hired employees, the results of FEE_APP may not be available on the first day of paid status.

  • The provider must initiate the FEE_APP process no sooner than 30 days prior to hire and no later than the first day of paid status.
  • The FEE_APP application is valid for 10 working days, during which the employee must provide the application to the vendor and complete fingerprinting.
  • ISP has 45 days to return background check results to the HCWR.

If the initial HCWR check does not reflect the FEE_APP date, rerun the HCWR check after the FEE_APP date is recorded.

Special Notes:

Individuals continuously employed at the same provider since before October 1, 2007, with a Uniform Conviction Information Act (UCIA) name-based or fingerprint check on HCWR are not required to complete a new fingerprint check unless hired by another provider under the Illinois Health Care Worker Background Check Act.

If HCWR shows 'Work Eligibility: Not Yet Determined,' a new or potential employer must initiate a Livescan fingerprint request.
