Meeting Minutes:

  1. Opening/Roll call of Board Members:
    • Members Present: Stacey Aschemann, Mike Bibo, Kathy Carmody, Katherine Hamann, Vickie Kean, Jeff Rath, Maggie Lyons, Scott Mendel, Beth Owens, Meg Cooch, Pamela Winsel.
  2. Annual Trainings Reminder:
    • Members were reminded to complete required annual trainings. Several members have had log in issues but continued to work through them; as a result, most have been able to access and complete the trainings. DDD staff will continue to email board members each week reminding them to complete the trainings. One board member commented that when they reached out for assistance, the link was never sent to them. DDD will reach out to this member and provide additional assistance.
  3. Status of Rules
    1. Rule 119- Certification of Developmental Training Programs
      • In 2024 the Department of Human Services (DHS), Division of Developmental Disabilities (DDD) withdrew draft Rule 119 from the administrative rule amendment process. The timeframe to complete the rule amendment process was close to expiring, Developmental Disabilities stakeholders continued to have questions and issues with the draft and the Joint Committee on Administrative Rules (JCAR) had suggested technical changes to the draft document. Per JCAR, Community Day Services (CDS, a program being added to Rule 119) is not specified in statue (a law enacted by legislation)
      • The DDD has proposed changes to the statues to define and describe CDS, outline DDD's authority over the program and identify provider requirements. DDD will not submit Rule 119 to JCAR until the Governor's Office signs off on the bill(s); this occurs in the Spring. Until this occurs, DDD will start the DHS internal review process in order to have the draft Rule to move forward.
      • A DD Regulatory Advisory Board (RAB) member commented that CDS is a service which continues to evolve and would like to look at the draft again. DDD staff will send draft Rule 119 to Board members prior to the January DD RAB meeting.
    2. Rule 115- for Community-Integrated Living Arrangements
      • The Division recently had a Community Integrated Living Arrangement (CILA) Legislative audit for 2021, 2022, and 2023. During the audit, the auditors determined a definition needed for emergency calls in the rule per the CILA Licensure and Certification Act (210 ILCS 135/13.2). This requirement was added to the statue while Rule 115 was being updated and was not included in the updated version.
      • DDD attempted to add the requirement to Rule 115 through the emergency Rule amendment process but was redirected; the proposed amendments to Rule 115 are not appropriate for an emergency Rulemaking. This amendment might be seen as an agency created situation and it does not constitute a threat to the public interest, safety or welfare which are 2 of the emergency Rulemaking criteria.
      • DDD will revise Rule 115 through the regular Rule process, which includes a review by the DDD Regulatory Advisory Board, an Administrative Review by DHS and then to JCAR, who, if accepted, will post the draft Rule for public comment. The revised Rule 115 will only contain changes related to "emergency calls"; the Division will not include other changes at this time.
    3. Rule 116- Administration of Medication
      • The DDD's Bureau of Clinical Services has been meeting for the past several months to revise Rule 116. The draft will be ready to circulate through DDD by mid-November. DDD is checking to see if Healthcare and Family Service's Policy Review System and/or the Department of Public Health needs to review. Then, the draft is anticipated to be ready for review of the DD Regulatory Advisory Board in January 2026.
    4. Rule 117- Home-Based Support Program
      • Rule 117 has not had any movement. The Board reviewed it in 2023, DDD moved it on to JCAR to conduct a "pre-review". JCAR reviewed, DDD responded to the review comments and the process did not progress from there. DDD will push to get the Rule 115, 119 and 116 moving to JCAR/First Notice, then move forward with Rule 117.
  4. 2026 meeting dates/times
    • The Board members agreed to schedule 2026 meetings for the fourth Thursday of each month, from 1:30pm-3:30pm. Additional meetings can be added if necessary.
