Facilities without Inpatient Mental Health Treatment Programs

"Mental health facility" means any licensed private hospital or hospital affiliate, institution, or facility, or part thereof, and any facility, or part thereof, operated by the State or a political subdivision thereof which provides treatment of persons with mental illness and includes all hospitals, institutions, clinics, evaluation facilities, mental health centers, colleges, universities, long-term care facilities, and nursing homes, or parts thereof, which provide treatment of persons with mental illness whether or not the primary purpose is to provide treatment of persons with mental illness. Firearm Owners Identification Card Act (430 ILCS 65/1.1) 

Facilities without Inpatient Mental Health Treatment Programs include:

  • Hospitals without Inpatient Mental Health Treatment Programs
  • Outpatient Mental Health without Inpatient Mental Health Treatment Programs
  • University Clinics without Inpatient Mental Health Treatment Programs
  • Mental Health Centers without Inpatient Mental Health Treatment Programs
  • Medical Clinics without Inpatient Mental Health Treatment Programs
  • Nursing Homes without Inpatient Mental Health Treatment Programs

Physicians, Clinical Psychologists, Advanced Practice Psychiatric Nurses, and Qualified Examiners at facilities without Inpatient Mental Health Treatment Programs are required to report the following: 

  • Persons that are determined to be a "Clear and Present Danger."* 
  • Persons that are determined to have a "Developmental Disability."
  • Persons that are determined to have an "Intellectual Disability."

Clear and Present Danger events are required to be reported to the FOID Mental Health Reporting website within 24 hours. Developmentally Disability events are required to be reported within 7 days of the determination. (Mental Health and Developmental Disabilities Confidentiality Act 740 ILCS 110/12(b))
