Section A. SCOPE OF WORK

A.1. OVERVIEW AND PURPOSE

The Illinois Department of Human Services' Division of Developmental Disabilities (DHS' DDD) seeks to fund applicants to provide a 24-hour Stabilization Home (SH) designed to meet the needs of individuals with intellectual and developmental disabilities (I/DD) ages 18+ who are experiencing acute behavioral health conditions.

This Request for Applications is in accordance with the State of Illinois Public Act 103-0493.

The purpose of this programming is to divert placement into a State Operated Developmental Center and/or ensure stability in community placements.

The intent is to award 10 agreements for Stabilization Homes (SH) with no more than 4 people residing in each home. Each agreement is for 1 home. The Stabilization Home program will have short-term programming and long-term programming. Individuals participating in short-term stabilization programming will have an anticipated stay of 90 days. Individuals participating in the

Long-Term Stabilization programming will be anticipated to stay of 1-2 years.

It is expected that the successful Applicants will provide comprehensive clinical supports and collaborate with the individuals' families/guardians and/or other entities providing services to the individuals in developing a plan for successful return to the community.

DHS' DDD is committed to promoting the integration and inclusion of people with developmental disabilities into their local communities. DDD's goal is to ensure that individuals with developmental disabilities receive the services and supports they need to lead fulfilling and productive lives in their local communities.

A.2. DESIRED OUTCOMES OF THIS PROJECT/ENGAGEMENT

The successful Applicants must be able to meet the following deliverables:

  1. Ability to receive/admit individuals within 24 hours of notice (when capacity exists) on a no decline basis.
  2. Provide staffing, capacities and competencies which accommodate intensive and specialized delivery of stabilization services to individuals who present with serious and challenging behaviors. There must be evidence of the following:
    1. Ability to implement positive and necessary behavior interventions 
    2. Development of sustainable behavior plan and interventions 
    3. Monitoring and tracking individuals' behavior
    4. Ability to staff on a 1:1 ratio if clinical needs require this
    5. Provide trauma informed care
    6. Provide linkage with appropriate clinical and behavioral services including, but not limited to, physician, psychiatrist or other psychiatric services provider, ancillary therapies, e.g. psychologist, speech, OT, PT etc.
  3. Clients who receive short-term programming must be ready to transition back to their originating provider within 90 days.
  4. Clients who receive long-term programming must be ready to transition to a community provider within 1-2 years.
  5. Provide must have access to day programming for individuals who would like to attend day programming.
  6. Must have a reliable mechanism to submit billing to the Department.
  7. Must be compliant with the following administrative rules:
    1. Rule 115 - 59 Ill. Adm. Code 115 - Standards and Licensure Requirements for Community-Integrated Living Arrangements
    2. Rule 116 - 59 Ill. Adm. Code 116 - Administration of Medication in Community Settings
    3. Rule 120 - 59 Ill. Adm. Code 120 - Medicaid Home and Community-Based Services Waiver Program for Individuals with Developmental Disabilities
    4. Home and Community Based Final Settings Rule 42 CFR §441.301(c)(4)(i-v)

Applicants are encouraged to propose sustainable innovative approaches to service delivery. However, the practice and clinical approach used to serve individuals through the program must emphasize the entire person, including his or her medical, psychological, social, and environmental circumstances which must be taken into consideration during the assessment, treatment and habilitation processes.

A.3. SCHEDULE & BUDGET

It is anticipated that the successful Applicant will accept their first referrals in January 2026.

DHS annual estimates for contract value is as follows:

  • Chicagoland rate for a home of 4:1, $1,644,560 ($411,140.08 per bed).
  • The statewide for a home of 4:1, $1,459,056.46 ($364,764.11 per bed).

A.4. UNIQUE CONSIDERATIONS

The successful Applicants must be an established 24-hour CILA provider in good standing with the DDD for at least 5 years. Prior to being approved to be an SH provider, the DDD must review the last 2 years' worth of surveys from the Bureau of Clinical Services (BCS), the Bureau of Quality Management (BQM), and the Bureau of Accreditation, Licensure and Certification (BALC).

The successful Applicants must be in compliance with all CILA rules and regulations, including but not limited to Rule 116, Rule 120, Rule 115, and the Federal Settings Rule. Links are provided on page 2, bullet point 7.

The successful Applicant must demonstrate that they have an effective method for managing and maintaining individual records. They must be able to produce records for audit purposes.

The successful Applicant must also be able to demonstrate competency in supporting individuals with behavioral health needs. Please see desirable F.3.5

Home Considerations

  • Successful Applicants must have no more than 4 people per address. Each bedroom must be single occupancy.
  • The interior of the home must be well maintained and person-centered. Individuals who receive services at an SH site must be able, and supported, to personalize their room to meet their needs and interests pursuant to the Federal Setting Rule 42 CFR §441.301(c)(4)(i-v)

Staffing Considerations

  • The successful Applicants must be able to accommodate the clinical needs of the individuals in the home, including but not limited to:
    • 1:1 staffing ratio of individual to direct support professionals (DSP), as clinically indicated.
  • All staff must be trained in crisis de-escalation.
  • The DSPs or Authorized Direct Support Professionals (ADSPs) must meet all DDD requirements necessary to work as a DSP or ADSP. Within 90 days of employment at an SH site, the DSP or ADSP must successfully complete the Registered Behavior Technician (RBT) training course.
  • Providers must meet all staffing requirements that are required by administrative rule. Please see page 2, A.2, bullet point 7.
  • Providers are required to provide psychiatric services, access to mental health supports (licensed clinical psychologist, licensed clinical social worker or licensed clinical professional counselor), and other staff (nurses and management) as needed to ensure treatment goals are met.

A.5. TERM

A.5.1. TERM OF THIS CONTRACT:

The contract resulting from this procurement will have an initial term commencing upon July 1, 2025 and ending on June 30, 2026. In no event will the total term of the contract, including the initial term, any renewal terms, and any extensions, exceed ten (10) years. Provider shall not commence billable work in furtherance of the contract prior to final execution of the contract except when permitted pursuant to 30 ILCS 500/20-80.

RENEWAL: Subject to the maximum total term identified above, DHS has the option to renew for the following term(s):

  • Renewal #1: July 1, 2026 through June 30, 2027
  • Renewal #2: July 1, 2027 through June 30, 2028

A.5.1.1. 

A.5.1.2. Any renewal of the resulting contract is subject to the same terms and conditions that apply to the initial term of the contract unless otherwise provided. DHS may renew the contract for any or all of the option periods specified, may exercise any of the renewal options early, and may exercise more than one option at a time based on continuing need and favorable market conditions, when in the best interest of the State. The contract may neither renew automatically nor renew solely at the Provider's option.


Section B. CURRENT CONDITIONS

B.1. OVERVIEW & BACKGROUND

There are currently 8 stabilization homes in operation: 4 in central Illinois and 4 in the south suburbs of Chicago. DDD would like stabilization homes across the State with a priority to Applicants with homes in service deserts. Please see desirable number F.3.11

B.2. VOLUMES & QUANTITIES

There are currently 8 SH sites across two providers. We are looking to open 10 additional sites.

Clients are admitted and discharged every 90 days on a rolling basis. In FY24, there were 39 clients admitted.

Successful Applicants will be required to staff homes at a 1:1 ratio if clinical needs require it (based upon risk assessments and professional judgement).

B.3. AREAS OF CONCERN/CHALLENGES

Providing behavioral supports to medically complex individuals is an opportunity for growth within the service system. DHS has experienced difficulty with clients in need of insulin administration being able to receive intensive behavioral supports. This is a high need and high priority for DHS to rectify.

Physically accessible homes are preferred.

An additional need is for homes that can provide supports to deaf clients and clients who are blind; preference is given to providers with supports tailored to this population.

Managing medication administration from the client's originating provider to the SH site can be challenging. The successful Applicant must have strong and consistent RN trainer supports.

B.4. STRENGTHS

Current SH providers do well when there is a lead staff/administrator that provides oversight to all SH programming and is the liaison to DHS. The successful Applicant must have an identified organizational structure that includes an identified liaison to DHS.

Section D. EVALUATION PROCEDURES

D.1. EVALUATION PROCESS

DHS will assess each Application for Responsibility (E.10) and Responsiveness. DHS considers the information provided and the quality of that information when assessing Applications. If DHS finds a failure or deficiency, DHS may reject the Application or reflect the failure or deficiency in the assessment.

DHS estimates ten (10) awards state-wide as a result of this Request for Application. DHS reserves the right to award fewer than ten (10) based upon applications received. DHS further reserves the right to include need of services for a given geographic region of the State when determining awards.

D.2. RESPONSIVENESS

A responsive Applicant is one who submits an Application that conforms in all material respects to the Request for Application and includes all required forms.

D.2.1. DHS will determine whether the Application complied with the instructions for submitting the applications. Except for late submissions, DHS may require that an Applicant correct deficiencies as a condition of further evaluation.

D.2.2. DHS will determine whether the Application meets the stated Technical requirements. Minor differences or deviations that have negligible impact on suitability of the services to meet DHS's needs may be accepted or corrections allowed. If no Applicant meets a particular Technical requirement, DHS may waive that requirement.

The Technical Requirements are described in Sections F.1., F.2., and F.3.

Section E. ADMINISTRATIVE REQUIREMENTS

E.1. GOVERNING LAW AND FORUM

Illinois law and rules govern this Request for Application and any resulting contract. Applicant must bring any action relating to this solicitation or any resulting contract in the appropriate court in Illinois. This document contains statutory references designated with "ILCS". CODE PART 1) are applicable to this solicitation. E.2. PUBLIC RECORDS AND REQUESTS FOR CONFIDENTIAL TREATMENT

Applications become the property of the State. All applications will be open to the public under the Illinois Freedom of Information Act (FOIA) (5 ILCS 140) and other applicable laws and rules, unless Applicant requests in its Application that the State treat certain information as confidential. A request for confidential treatment will not supersede the State's legal obligations under FOIA. The State will not honor requests to keep entire Applications confidential. Applicants must show the specific grounds in FOIA or other law or rule that support confidential treatment. Regardless, the State will disclose the successful Applicant's name, the substance of the Application, and the price.

If the Applicant requests confidential treatment, Applicant must submit additional copy/copies of the Application with proposed confidential information redacted. This redacted copy must tell the general nature of the material removed and shall retain as much of the Application as possible. In a separate attachment, Applicant shall supply a listing of the provisions identified by section number for which it seeks confidential treatment and identify the statutory basis or bases under Illinois law, including a detailed justification for exempting the information from public disclosure.

Applicants will hold harmless and indemnify the State for all costs or damages associated with the State defending Applicant's request for confidential treatment. Applicant agrees that the State may copy the Application to facilitate evaluation, or to respond to requests for public records. Applicant warrants that such copying will not violate the rights of any third party.

E.3. MINORITY CONTRACTOR INITIATIVE

The State requires a fee of $15 to cover expenses related to the administration of the Minority Contractor Opportunity Initiative. Any Applicant awarded a contract of $1,000 or more under Section 20-10, 20-15, 20-25 or 20-30 of the Illinois Procurement Code (30 ILCS 500) is required to pay a fee of $15. The Comptroller shall deduct the fee from the first check issued to the Provider under the contract and deposit the fee in the Comptroller's Administrative Fund. 15 ILCS 405/23.9.

E.4. FEDERAL FUNDS

The resulting contract may be partially or totally funded with Federal funds. Upon notice of intent to award, the percentage of supplies and/or services involved that are Federally funded and the dollar amount of such Federal funds will be disclosed.

E.5. EMPLOYMENT TAX CREDIT

Applicants who hire qualified veterans and certain ex-offenders may be eligible for tax credits. 30 ILCS 500/45-67 and 45-70. Please contact the Illinois Department of Revenue (217-524-4772) for information about tax credits [35 ILCS 5/216, 5/217].

E.6. RESERVATIONS

Applicants must read and understand the solicitation and tailor the Application and all activities to ensure compliance. DHS reserves the right to amend the solicitation, reject any or all applications, award by item/services, group of items/services, or grand total, and waive minor defects. DHS may request a clarification, inspect Applicant's premises, interview staff, request a presentation, or otherwise verify the contents of the Application, including information about subcontractors and suppliers. DHS may request Best & Final Offers when appropriate. DHS will make all decisions on compliance, evaluation, and terms and conditions, and shall make decisions in the best interests of the State and in accordance with the Illinois Procurement Code, rules and other applicable State and Federal statutes and regulations. This competitive process may require that Applicants provide additional information and otherwise cooperate with DHS. If an Applicant does not comply with requests for information and cooperate, DHS may reject the application as non-responsive to the solicitation. Submitting an application does not entitle Applicant to an award or a contract. Posting a provider's name in a Bulletin notice does not entitle the provider to a contract. DHS is not responsible for and will not pay any costs associated with the preparation and submission of any application.

E.7. AWARD

Awards shall be based upon points. DHS reserves the right to prioritize awards based on the clinical and geographic needs of individuals. If any aspects of the plan or mandatory elements cannot be met after an award is given, DHS reserves the right to rescind an award. For example, DHS can rescind an award if an awardee is not able to secure a home in the proposed geographical area within the specified amount of time.

E.8. INVOICING ADDRESS

The awarded Provider shall invoice at the completion of the contract unless invoicing is tied in the contract to milestones, deliverables, or other invoicing requirements agreed to in the contract. The Bulletin posting contains the "Bill-to Address:" where invoices should be sent.

Provider shall not bill for any taxes unless accompanied by proof that the State is subject to the tax. If necessary, Provider may request the applicable Agency's Illinois tax exemption number and Federal tax exemption information.

E.9. RESPONSIBILITY

A responsible Applicant is one who has the capability in all respects to perform fully the contract requirements and who has the integrity and reliability that will assure good faith performance. DHS determines whether the Applicant is a "responsible" Applicant; an Applicant with whom DHS can or should do business. For example, DHS may consider the following:

E.9.1. A "prohibited bidder" includes any person assisting an employee of the State of Illinois by reviewing, drafting, directing, or preparing any invitation for bids, a request for proposal, or request of information, or providing similar assistance unless such assistance was part of a publicly issued opportunity to review drafts of all or part of these documents. For purposes of this section, an employee of the State of Illinois means one who, by the nature of his or her duties, has the authority to participate personally and substantially in the decision to award a State contract. No person or business shall submit specifications to a State agency unless requested to do so by an employee of the State. No person or business that contracts with a State agency to write specifications for a particular procurement need shall submit a bid or proposal or receive a contract for that procurement need.

Nothing herein is intended to prohibit a provider from bidding, offering, or applying to supply developing technology, supplies or services after providing the State with a demonstration of the developing technology, supplies, or services; provided the subject of the demonstration to the State represents industry trends and innovation and is not specifically designed to meet the State's needs. Nothing herein is intended to prohibit a person or business from submitting a bid, offer, application, or entering into a contract if the person or business: (i) initiates a communication with an employee to provide general information about products, services, or industry best practices and, if applicable, that communication is documented in accordance with Section 50-39 of the Illinois Procurement Code or (ii) responds to a communication initiated by an employee of the State for the purposes of providing information to evaluate new products, trends, services, or technologies.

E.9.2. Other factors that DHS may use to evaluate to determine responsibility include, but are not limited to: political contributions, certifications, conflict of interest, financial disclosures, taxpayer identification number, past performance in business or industry, references (including those found outside the Application), compliance with applicable laws, financial responsibility, insurability, effective equal opportunity compliance, payment of prevailing wages if required by law, capacity to produce or sources of supply, and the ability to provide required maintenance service or other matters relating to the Applicant's ability to deliver in the quality and quantity within the time and price as specified in this solicitation.

E.9.3. Awarded Applicants must always have financial resources sufficient, in the opinion of DHS, to ensure performance of the contract and must provide proof upon request. DHS may terminate the contract, consistent with the termination for cause provision of the contract, if the provider lacks the financial resources to perform under the contract.

E.9.4. DHS may require that an Applicant correct any deficiencies as a condition of further evaluation.


Section F. PROPOSAL FORMS

Please refer to table in Section A.1 of this RFA regarding documents to submit as part of your application.

F.1. CONTRACT TERMS

Please read each item carefully. By submitting an application, you are agreeing to each of the following that shall be part of all resulting contracts awarded from this RFA.

CONTRACT TERMS

F.1.1. The Applicant must accept all individuals on a no-decline basis, within 24 hours of receipt of intake information from DDD.

F.1.2. Applicants must remain in compliance with all CILA rules and regulations, including but not limited to, Rule 116, Rule 120, Rule 119 (if applicable), Rule 115, and the Federal Settings Rule. Please see links on page 2, A.2, bullet 7.

F.1.3. Applicants are required to provide the following supports as needed: Qualified Intellectual Disabilities Professional (QIDP), Board Certified Behavior Analyst (BCBA) services, psychiatric services, access to mental health supports (licensed clinical psychologist, LCSW, or LCPC), and other staff (nurses and management) to ensure treatment goals are met.

F.1.4. The Applicant agrees to manage and maintain individual records which will be produced for audit purposes.

F.1.5. All SH sites must staff the home at a 1:1 ratio of individual to direct support professionals (DSP) if clinically needed based on risk assessment and professional judgement.

F.1.6. The DSPs or ADSPs must meet all DDD requirements necessary to work as a DSP or ADSP. Within 90 days of employment at an SH site, the DSP or ADSP must successfully complete the Registered Behavior Technician (RBT) training course.

F.1.7. Applicant must have a licensed CILA with 4 bedrooms secured within 6 months of accepting this agreement.

Applicable State Rules and Codes

F.2. MANDATORY REQUIREMENTS WITH EVIDENCE

Please answer each of the mandatory requirements in the table supplied in Request for Application Response for Stabilization Homes for the proposed solution. An Applicant that does not provide substantiating evidence for each requirement will be disqualified and the rest of the proposal will not be scored.

These Mandatory Requirements shall be included in any contract resulting from this solicitation.

Please provide substantiating evidence in your Proposed Technical Solution. Please use the provided Request for Application Response for Stabilization Homes to respond to each Mandatory with Evidence requirement. DHS will evaluate Applicant's evidence/response to verify the mandatory requirement is met.

MANDATORY REQUIREMENTS WITH EVIDENCE

F.2.1. The Applicant must be an established 24-hour CILA provider in good standing with the DDD for at least 5 years.

F.2.2. Applicant must attach resumes of key staff including:

  1. Behavioral staff (behavior analyst)
  2. RN Trainer
  3. DHS liaison

F.2.3. Applicant must submit plan or policy for training DSPs to be a registered behavior technicians (RBT).

F.2.4. Applicant must submit policies guiding medication training. This specifically includes:

  1. The process in which DSPs are trained to be ADSPs to pass medications
  2. The process in which the Applicant transitions a new client into their agency

F.4. PRICING

DHS shall pay Successful Applicants according to the approved fee-for-service reimbursement rates.

F.4.1. TYPE OF PRICING: The Illinois Office of the Comptroller requires the State to indicate whether the contract pricing is firm or estimated at the time it is submitted for obligation. Pricing pursuant to this contract is firm.

F.4.2. TAXES: Pricing shall not include any taxes unless accompanied by proof the State is subject to the tax. If necessary, Applicant may request the applicable agency's Illinois tax exemption number and federal tax exemption information.

F.4.3. APPLICANT'S PRICING OFFER:

Renewal Compensation: Renewals shall be payable at the applicable fee- for-service reimbursement rates.
