SUBJECT: WIC Vendor Notice 23-05 - Contract Amendment - Medical Nutritional Product Sales Limitations
DATE: June 30, 2023
Effective August 1, 2023, vendors assigned to Peer Groups 1-3 Urban and 1-3 Rural will no longer be authorized to sell Exempt Infant Formula and WIC-Eligible Nutritionals. Products include all formulas listed in Category 31 and 41 of the Authorized Product List (APL) which are referenced in the attached document.
In accordance with section XII. of the WIC Vendor Contract, the department is amending the following portions of section VIII. Conditions of the Contract.
Current:
The Vendor shall provide only to authorized WIC Cardholders only approved foods in exchange for valid benefits issued by the Department as follows:
- Sell only approved foods as allowed by the APL; and
- Sell only approved canned, fresh, or frozen fruits and vegetables; and […]
Revised:
The Vendor shall provide only to authorized WIC Cardholders only approved foods based on current Vendor Peer Group assignment in exchange for valid benefits issued by the Department as follows:
- Sell only approved foods as allowed by the APL; and
- Sell only approved canned, fresh, or frozen fruits and vegetables; and
- Vendors with the peer group assignments of 1-3 Urban and 1-3 Rural are NOT authorized to sell foods in the Exempt Infant Formula and WIC-Eligible Nutritionals categories of the WIC APL.
- Any attempted redemptions of product in the Exempt Infant Formula (31) or WIC-Eligible Nutritionals (41) categories will not be paid to vendors in peer groups 1-3 Urban and 1-3 Rural. […]
If this amendment is determined to be unacceptable, the Vendor may voluntarily withdraw from participation pursuant to Section 460 of the Code (Appendix A).
