There are several upcoming changes to the Illinois WIC Formulary due to a new contract and expiration of USDA waivers related to the infant formula shortage in 2022.

As the current Illinois infant formula contract with Mead Johnson-Reckitt came to an end on 1/31/2023 a new, 3-year, WIC Infant Formula Rebate contract began with them effective 2/1/2023. No major changes to the formulary were made at this time.

Based on the improving supply of standard infant formula across all brands, USDA flexibilities allowing states to use WIC food funds for non-contract formulas will end on 2/28/2023. On 2/27/2023 foreign formulas added to the Illinois formulary in the summer of 2022 will no longer be available as an alternative purchase with Illinois WIC benefits. This includes all Bubs, Kendamil, and Aptamil formulas.

The USDA waiver providing flexibility in container size for contract formula remains in effect through April 30, 2023, or 60 days after the expiration of the COVID-19 major disaster declaration whichever is earlier. Illinois' agreement with Mead Johnson-Reckitt currently allows the alternative can sizes to be purchased through 4/30/2023 and will be reassessed moving into March. This means that only the following Mead Johnson-Reckitt Formula products and sizes will be eligible after 4/30/2023:

  • Enfamil Infant Powder 12.5oz
  • Enfamil Infant RTF 32oz
  • Enfamil Gentlease Powder 12.4oz
  • Enfamil AR Powder 12.9oz
  • Enfamil ProSobee 12.9oz

WIC Vendors should be working with their Primary Infant Formula Suppliers now to obtain stock of the original can sizes of Enfamil contract formulas to allow them time to procure sufficient supplies in advance of the deadlines. The current minimum stock requirement waiver is expected to expire 06/30/2023 and all vendors will be required to maintain minimum stock of Enfamil Infant Powder 12.5oz and Enfamil ProSobee Powder 12.9oz at all times in the quantities specified on the Minimum Supply List.
