Meeting Minutes
Roll call/Introductions. Members Present: Stacey Aschemann, Mike Bibo, Kathy Carmody, Amie Lulinski, Andrea Medley, Scott Mendel, Beth Owens and Allison Stark. Members Absent: Krescene Beck Larry Eaton, Katherine Hamann, Vickie Kean, Donta Jones, Meg Lewis, Pamela Winsel
Status of draft Rules: Rule 120 and 117 are currently under Executive Review with DHS. Once the Executive Review process is complete, the Rule will move on to JCAR to be published for First Notice. Rule 119 revisions will be completed within the next 2 weeks and sent to the DHS Rules Bureau to start the Executive Review process.
Discussion on draft Rule 115: Draft Rule 115 was recently withdrawn from the JCAR process. It was suggested that due to the significant changes made it would be best to re-file for First Notice that all stakeholders have a chance to review the draft language and time to respond. The Division reviewed the latest draft of Rule 115 with the Board who should send any additional comments, after today's discussion, to DHS staff by March 8, 2022. This short time frame is to ensure the Rule is ready to send to JCAR and be post for First Notice in a timely manner.
Section 115.215: board members provided comments on the draft language around individual absences. It was suggested that there should be a solution to the issue of long-term absences; not unlimited bedhold but a maximum number of days a person can be absent from the CILA.
Section 115.310: DDD will consult with DHS legal and also with CMS technical regarding proximity limits on CILA sites. The draft language includes a limit on provider-controlled units in a larger building, not for individually owned or controlled sites.
Section 115.230 b): the Division will check to see if we clarification is needed regarding the 30 day requirement for Providers to complete implementation strategies.
