To meet the noncitizen requirements for this status for TANF, AABD, FamilyCare Assist, and GA, the person must:
- have been residing in the U.S. on 08/21/96 and
- currently be lawfully admitted for permanent residence.
A person who enters the U.S. on or after 08/22/96 must live in the United States for 5 years after being lawfully admitted, to meet citizenship status.
A person who entered the country under a classification which is exempt from the 5 year residency requirement remains exempt from the 5 year residencey requirement even if they are adjusted to LPR status. See PM 03-01-02-d, PM 03-01-02-e and PM 03-01-02-f.
A person under age 19 who is lawfully admitted for permanent residence is eligible for all All Kids programs, regardless of how long they have lived in the United States.
