PM 01-07-10-d: Dismissal Due to Nonappearance

WAG 01-07-10-d.

The appeal is dismissed by the hearing officer if the client or their representative:

• fails to appear at the time and place set for the hearing and a postponement has not been granted, or
• refuses to proceed with the hearing and a continuance is not granted.

The Bureau of Assistance Hearings notifies the client or representative of the dismissal and sends a copy of the notice to the Family Community Resource Center.

When an appeal is dismissed, make any planned changes in benefits at once. Do not wait for the written decision from BAH.
