The client or their representative may withdraw the appeal at any time during the appeal process until the final hearing decision is issued. The withdrawal of an appeal must always be in writing. If the representative has Power of Attorney, the client cannot withdraw the appeal without the consent of the representative except in one instance: during the appeal hearing if the representative is not present and the client wants to withdraw the appeal, the withdrawal can be accepted.
The Family Community Resource Center may change the action to correct an error. Explain our policy to the client and that we are revising our action. If they agree with our revised action, ask them to withdraw the appeal. The Family Community Resource Center must send a corrected notice before any negative action can be taken.
