Clients found to have committed an IPV are disqualified for a length of time and must repay the overpayment. The disqualification can be either administrative or court ordered. The SNAP unit must make the repayment while the disqualification is against the client.
Administrative disqualifications run for the following lengths of times:
- First violation - 12 months
- 2nd violation - 24 months
- 3rd violation - permanently
Court ordered disqualifications run for the following lengths of time:
- First violation - 12 months
- First violation for trading benefits for a controlled substance - 24 months
- First violation of trading benefits for firearms, ammunition, or explosives, or
buying selling, stealing or trading SNAP benefits of more than $500 - permanently
- 2nd violation - 24 months
- 2nd violation of trading benefits for a controlled substance - permanently
- 3rd violation - permanently
NOTE: If an IPV happened before 06/15/88, do not count it as a prior violation unless the client signed a waiver form at either the Pre-Hearing Conference or the ADH.
A person is disqualified from receiving SNAP benefits for 10 years when an ADH or a Federal or State court convicts them of making a false statement or representation about their identity or residence, in order to receive more than one SNAP issuance at the same time.
