PM 20-08-13: Suspected Abuse and Neglect of Residents

WAG 20-08-13.

State law requires all staff to immediately report to DPH (HFS for SLF residents) any time they reasonably believe that a client they have direct contact with has been abused or neglected in an LTC/SLF.

  • Abuse is intentional physical or mental injury or inappropriate sexual activity.
  • Neglect is the failure of the facility to provide adequate care to the client that could result in physical or mental injury or the deterioration of the client's condition.

Long Term Care Facilities

Make reports of suspected abuse or neglect to DPH. Reports can be made in writing, by phone, or in person. The person making the report is not required to give their name, but it is helpful to DPH in their investigation.

DPH must investigate life threatening reports within 24 hours. Other complaints must be investigated within 7 days. DPH will tell the facility of the results of its investigation within 10 days. DPH will also tell the person who made the report, if the person is known. Both the facility and person who made the report have 30 days to request a hearing if they disagree with the DPH decision.

Supportive Living Facilities

Make reports of suspected abuse or neglect to HFS - Bureau of Long Term Care (BLTC) by calling 217-782-0545. Follow-up in writing.

HFS must investigate all reports of suspected abuse or neglect within 7 days. HFS will tell the facility of the results of its investigation. The facility has 30 days, from the date of notification by HFS, to request a hearing if they disagree with the HFS decision.
