PM 15-04-04-e: Veterans Benefit Disregard (Nursing Home)

The Department of Veterans Affairs (DVA) limits monthly Veterans benefits (VA) to $90 for any Medicaid eligible:

  • veteran who is a nursing home resident, and who does not have a spouse or child; or
  • veteran's surviving spouse who is a nursing home resident, and who does not have a child.

When a veteran or surviving spouse provides proof that their monthly Veterans benefit has been reduced to $90, deduct the $90 disregard when figuring the nursing home credit amount. Allow this deduction starting with the first calendar month that VA checks are reduced to $90. Do not use the $30 Revised textPersonal Needs Allowance (PNA) as a deduction for these persons.

Allow the $30 Revised textPNA for Revised textnursing home residents where monthly VA benefits are not limited to $90, see PM 15-06-02.

Do not allow both the $30 Revised textPNA and the $90 Veterans Benefit Disregard for the same month.
