If funds for a burial space are held in a trust, review the document that set up the trust. Document the burial space amount in the case record. Any portion of a contract that clearly represents the purchase of burial space is exempt, regardless of value.

If burial merchandise is specified in a prepaid burial plan, the amount specified is exempt as burial space. For example, a client has a prepaid burial plan specifying $800 for a casket, $500 for a vault, and $1,500 for services. The $800 and $500 are exempt as burial spaces, and the $1,500 is burial funds.
