The client can choose to keep benefits (other than child care) in the old amount or accept the new amount during the appeal. (Child care benefits are not continued during an appeal.) If the Final Appeal Decision is that the benefits should be reduced, canceled, or stopped, the client must repay any excess cash and SNAP benefits received.
The client's benefits may be changed or even canceled during the appeal process. But, this change must be for a reason other than the issue being appealed. The client has to receive a written notice of change before we change their benefits due to the new reason.
Be aware of changes in case status or benefit amounts while the appeal is pending. Consider these changes when taking any action in response to the appeal ruling or to a client's request to withdraw the appeal.
