The Department of Veterans Affairs (DVA) limits monthly Veterans Benefits (VA) to $90 for any Medicaid eligible:
- veteran who is a nursing home resident and who does not have a spouse or child; or
- veteran's surviving spouse who is a nursing home resident and who does not have a child.
Deduct the $90 disregard when a veteran or surviving spouse provides proof that their monthly Veterans benefit has been reduced to $90. Allow the deduction starting with the first calendar month that VA checks are reduced to $90. Do not use the $60 Personal Needs Allowance (PNA) as a deduction for these persons.
Allow the applicable $60 PNA for nursing home residents who have monthly VA benefits that are not limited to $90.
Do not allow both the $60 PNA and the $90 Veterans Benefit Disregard for the same month.
