A. Holidays
Absences due to recognized holidays will not be counted as an absence when the customer was scheduled to participate in an activity but was not able to meet requirements due to the holiday.
- The customer's participation hours will not be reduced for absences due to holidays.
- Only 10 holidays per year may be counted. The 10 recognized holidays are as follows:
- New Year's Day
- Martin Luther King Day
- Presidents' Day
- Memorial Day
- Independence Day
- Labor Day
- Veterans' Day
- Thanksgiving Day - Thursday
- Thanksgiving Day - Friday
- Christmas Day
B. Absences
The Provider is responsible for indicating, for each absence, the number of absent hours and the reason for each absence in the "comments" section of the weekly attendance and activity report. FCRC caseworkers are responsible for determining when hours of excused absence result in the customer meeting the participation requirement. Providers should work with customers to make up missed hours by the last Friday of the month.
C. Method for Calculating Average Hours Per Week
Calculate the average hours per week by dividing the total number of hours by the number of weeks in the month. For weeks that fall across more than one month, the last week of the month is that in which the last Friday falls.
D. Deeming
The Fair Labor Standards Act (FLSA) determines the maximum number of hours to which we may assign an individual in work-like activities. (WAG 03-13-01-b) Customers may not be assigned more hours than the total amount of cash and SNAP benefits divided by the larger of state or federal minimum wage. For the three FLSA activities (Work First, Work Experience or Community Service), the core participation requirement is deemed met for a case when the client(s) participates the number of hours indicated by the FLSA calculation.
If the hours calculated are greater than the core requirement, use those hours toward meeting the Participation Target if additional hours are needed. If the hours calculated are greater than the Participation Target, only assign and hold the person accountable for hours up to the Target. If supplemental hours are needed to bring the case up to the Target, use any of the other Countable non-FLSA activities.
