Dear Home Services Program Customer:

On March 14, 2017, the General Assembly's Joint Committee on Administrative Rules adopted overtime rules for the Home Services Program. This rule went through the agreed-upon rulemaking process. The Illinois Department of Human Services carefully considered written comments and suggestions fielded at two public hearings, and included many of these suggestions in the rules. These rules will enhance customer security and safety, create jobs, and ensure the long-term sustainability of the program to allow individuals with disabilities to continue living independently in their homes.

The overtime rules go into effect on August 1, 2017. Customers and Individual Providers are required to comply with the overtime rules. Enclosed with this letter is a Home Services Program Customer Guide To Overtime Rules. This document explains the details of the rules. It also provides a step-by- step guide for what you should do now to prepare for the rules to go into effect on August 1, 2017.

Under the rules, Customers are required to hire additional Individual Providers when their Service Plan has more than 45 hours per week. The Department understands it may take time to locate and hire additional Individual Providers; therefore, the Home Services Program (HSP) will not enforce the overtime rules until August 1, 2017. This delay will provide you with more than 90 days to hire additional Individual Providers. If you need help finding additional Individual Providers, please contact your local Center for Independent Living or your local HSP office.

Customers with more than 45 hours per week in their Service Plans may apply to use overtime. The enclosed Home Services Program Customer Guide To Overtime Rules includes the details about when overtime may be used and how to apply for pre-approval to use overtime.
