Policy Memo: Elimination of Estate Claims for Medicare Savings Program

Medicare Improvements for Patients and Providers Act of 2008 (Part II, Section 115) (MIPPA) eliminates estate recovery for Medicare cost sharing.   

Persons who receive benefits under the Medicare Savings (MSP) Program, on or after January 1, 2010, are exempt from the estate recovery requirement. Do not place an estate claim on persons who are enrolled in the Medicare Savings Program (MSP) only.  Form 8, Real Property Record, is no longer required for MSP only cases.

HFS Bureau of Collections will continue to enforce any existing estate claims on MSP prior to January 1, 2010.
