The Department pays any attorney, or advocate working under the supervision of an attorney, who represents a P3 TA client in an appeal of an SSI denial. To receive P3 TA, the client has been found disabled by CAU. For the attorney to qualify for
- the appeal must be before an Administrative Law Judge,
- the appeal must be decided in the client's favor, and
- the award must solely be an award for SSI.
Attorney fees are not paid when the client is awarded both SSI and regular Social Security disability (Title II) benefits at the same time.
The amount of the payment is 25% of the maximum SSI grant payable to the client for a period of one year.
