(FCRC) When a decision is made that a PE applicant or case is not eligible, deny the PE case or delete the ineligible person(s).

  1. Deny the PE case or delete the ineligible person(s).
    1. To deny a PE case, complete Form 552 as follows:
      • Items 2, 4, and 6 - Complete.
      • Item 3 -Enter TA 22.
      • Item 33 -Enter the correct closing TAR. See WAG 27-33-01-n and WAG 27-33-01-s.
        • NOTE: It is important to certify and deny a PE case's eligibility if the case was eligible for the period during which the case was in PE status. To deny and certify a PE case at the same time, complete Form 552 as described above, and complete Item 32 as follows.
      • Item 32 -Enter the month and year for which the PE case is being certified (i.e., the earliest date for which continuous eligibility has been established).
    2. To delete an ineligible person before you certify the case, see see WAG 25-07-11.
  2. Send the caretaker relative the proper pages and sections of the Form 360 series to advise of the:
    • reason for denial of the TANF-PE case; or
    • the reason the person(s) is ineligible.

      NOTE: When a PE application is denied, and the applicant appeals the decision by the date of change, do not continue benefits while the appeal is pending. 

  3. At the same time that you process the denial, or deletion, determine 94R eligibility for any ineligible child(ren) (see PM 06-11-01).
  4. If 94R eligibility exists, register a 94R application using a blank Form 552 as follows:
    • Item 1 -Enter complete case number.
    • Item 2 -Enter as the date of application (6-digit date), the original application date for the TANF case.
      • Example: TANF case registered 04/02/98. TANF case approved presumed eligible (PE) effective 04/15/98. TANF case denied effective 07/98. The 94R application is registered using 04/02/98 as the registration date.
    • Item 3 -Enter 01 or 02 as required.
  5. If the child(ren) are eligible for 94R, approve the 94R application (see WAG 06-08-00). Complete the approval Form 552 as follows:
    • Item 2 -Enter the month and year (4-digit date) that is 3 months prior to the month of the 94R application.
      • Example: The 94R application is registered 04/02/98. When the 94R case is approved, enter 01/98 in Item 2.
  6. Record, in the PE case record, that a 94R case was set up. Write the 94R case number on the outside of the existing TANF-PE record. The case record now belongs to both cases.
  7. If the child(ren) are ineligible for 94R, do not send a MANG denial notice to the client, regarding the child(ren)'s ineligibility for the 94R case when:
    • eligibility for 94R does not exist; and
    • client did not request medical benefits for the child(ren).
  8. Make a separate determination of ongoing Food Stamp eligibility if the denied TANF-PE case was receiving food stamps. Base Food Stamp eligibility on information included in the TANF-PE case record.

Certifying a Denied PE Case

(FCRC) It is important to certify a denied case if information is received that the case was eligible during the period that the case was in PE status. Certify the denied case as follows if a later action has not been taken (i.e., registration of a reapplication). To certify the case, complete the denial Form 552 if available.

  • Item 1 -Line through the letters PE.
  • Item 2 -Complete.
  • Item 3 -Enter TA 39.
  • Item 32 -Enter the month and year for which the PE case is being certified (i.e., the earliest date for which continuous eligibility has been established).

If a later action has been taken, the case is no longer considered inactive and TA 39 may not be used. If such a situation occurs, complete and send the Request for Correction/Addition to MMIS Medical Eligibility File (Form 2958), to the Exception Processing Unit, Springfield, to backdate medical.
