If a SNAP unit's TANF monthly benefit amount or SSI benefits are reduced because of a recoupment due to a noncompliance with program requirements, the recoupment amount is counted as available unearned income. The recoupment amount is called the
noncompliance amount.
Noncompliance with program requirements occurs when a unit member is:
- convicted in a criminal case of fraudulently obtaining an overpayment, or
- judged in a civil case to have fraudulently obtained an overpayment.
