WAG 07-01-14
Any trust fund set up in the name of a client who is an adult or child is an inaccessible asset if the trust fund:
- was set up by a court order that prohibits immediate access to or disbursement of the funds; or
- is held by a financial institution as a trust fund and the money cannot be disbursed from the fund without a court order.
For any other trust fund or monies said to be a trust, request specific case guidance from the Bureau of Financial Support Policy as to the fund's availability. While the review is in process, consider the asset as inaccessible and process the application in the normal manner.
Clients do not have to petition the court for release of trust funds.
