In determining the total amount of assets available to a case, use the assets of any person in the home who is legally responsible for anyone in the case, such as a spouse. Do not use the assets of any person in the home who is not
legally responsible. Apply the total amount of available assets to the asset limit for the unit.
To determine the asset limit for the unit, include all persons in the home for whom the responsible relative and the client are legally responsible.
If total nonexempt assets are greater than the asset limit for the unit, the case is ineligible.
