When you learn that a person who must be included in the case by filing unit policy is in the home, take the following action:
- Complete Filing Unit Notice (Form 2691) in duplicate. Mail the original to the customer. File the copy in the case record.
For newborns, immediately add the child for cash and medical. The effective date is the date the child was born. A child is a newborn from birth through 12 months. See WAG 18-03-01 for directions on adding the child.
For all others, do not add the person until eligibility is verified.
- Set a control for 30 days for the customer to return what is needed.
- When the customer returns what is needed, add the person to the case beginning the date the person was required to be in the case (see WAG 18-03-06). For example, add an adjudicated father from the date paternity was established, or the date he moved into the home, whichever is later.
Determine if an overpayment exists if the person being added has or had nonexempt income or assets.
For newborns, who have already been added, no other action is needed.
- If the customer fails to return what is needed, take action on the case. The action taken depends on what information the customer fails to provide.
If a customer fails to provide an SSN or proof of application for an SSN for a newborn, change the child to medical only (enter code 3 in Item 78).
If a customer fails to provide an SSN or proof of application for an SSN for a child over 12 months of age or for an optional person, do not add the child or the optional person to the cash case.
If a customer refuses or fails to provide an SSN or proof of application for an SSN for an adult parent of a child in the case and the adult parent is a U.S. citizen or eligible noncitizen, SWAP the cash case.
If a customer fails to provide proof of income for the new member, SWAP the cash case without including the new member (see WAG 18-02-02).
