If the client responds to the notice of termination by stating that an appeal is pending at the reconsideration or ALJ level, review SDX and SOLQ information. SOLQ provides the date of the appeal as well as the appeal code. If SDX or SOLQ does not confirm the client's statement, request proof from the client. A written statement from SSA verifying the pending appeal must be dated within the previous 90 days. Upon receipt of proof that an appeal is pending at the reconsideration or ALJ level, resume or restore P3 without any further action by the client.
With the resumption or restoring of P3, the Department must stop claiming matching federal funds. (With the CAU finding of disabled, the Department can claim matching federal funds for medical assistance at the time of approval. When SSA subsequently finds the client "not disabled," the Department must stop claiming matching federal funds until SSA reverses their decision.)
With the resumption of a suspended case, a code is centrally entered on the case to identify the case as a client with an SSI appeal pending (no matching federal funds).
When assistance is restored, the Family Community Resource Center must enter a code to identify the case as a client with an SSI appeal pending.
